1. Service Description

BondPermit ("BondPermit," "the Service") is a permit and license research service operated by AurumFlux AI, Inc., a California corporation (entity number B20260246521) ("AurumFlux," "we," "us"). BondPermit (bondpermit.com) uses artificial intelligence to research permit and license requirements from public government sources.

2. Acceptance of Terms

By accessing or using any AurumFlux service at bondpermit.com or any associated subdomain, you agree to these Terms of Service. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 18 years old to use BondPermit. By using the Service, you represent that you are at least 18 and have the legal capacity to enter into a binding agreement.

4. Subscription Plans and Pricing

BondPermit pricing (USD): Complete Launch Report $49 one-time · Watchdog Monitoring $9.99/month recurring. Additional tiers may be added with notice. Prices may change with 30 days' written notice to active subscribers; one-time purchases are not affected by future price changes.

5. No Revenue Share

BondPermit does not operate any revenue-share program. Your purchase of a one-time Complete Launch Report or a Watchdog Monitoring subscription does not entitle AurumFlux to any share of your business revenue, and you owe no percentage of your earnings to AurumFlux.

6. AI-Generated Content Disclaimer

All outputs produced by BondPermit — including but not limited to permit and license research reports — are generated by artificial intelligence and may contain errors, inaccuracies, or outdated information.

7. No Investment Solicitation

AurumFlux and BondPermit do NOT offer, solicit, or facilitate any investment, cryptocurrency, token, NFT, or securities. We do not accept investor funds through the platform. Any third party claiming to offer investments on behalf of AurumFlux or BondPermit is committing fraud — report them to [email protected] immediately.

8. No Financial or Investment Advice

8.1. BondPermit provides permit and license research only. It does not generate financial analysis, equity research, valuation models, investment recommendations, or price targets, and nothing BondPermit provides constitutes financial or investment advice.

8.2. AurumFlux AI, Inc. is NOT a broker-dealer, registered investment adviser, financial planner, certified public accountant, tax advisor, or fiduciary under the securities laws of the United States or any other jurisdiction. AurumFlux does not hold any securities licenses, investment advisory registrations, or financial services authorizations.

8.3. You must not treat any BondPermit output as advice to buy or sell securities, commodities, derivatives, or other financial instruments. Always consult a qualified, licensed financial professional before making any financial or investment decision.

9. Intellectual Property

You retain full ownership of all content, data, and intellectual property you provide to BondPermit. You also own all reports BondPermit generates specifically for your business. AurumFlux retains ownership of the BondPermit platform, its algorithms, and underlying technology.

We may suspend or terminate your account immediately if you violate these Terms. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No partial refunds for unused subscription time.

12. Refund Policy

Each BondPermit report is a custom research deliverable, generated specifically for your business type, city, and state. Before report generation (you have not yet received the report): contact [email protected] for a full refund. After report delivery: all sales are final, subject to the Error Challenge Process in Section 28.3. Error Challenge: if you find a specific factual element of your report is inaccurate and provide a citation from a public .gov source proving the correct value, we will refund the $49 you paid for the report and provide a corrected report at no additional charge (Section 28.3). Subscription services (Watchdog $9.99/month): refunds for the current billing period are prorated to the day of cancellation upon written request. Cancellation takes effect at the end of the current billing period. No fees are charged after cancellation.

YOUR USE OF BONDPERMIT AND ALL SERVICES, OUTPUTS, REPORTS, ANALYSES, RECOMMENDATIONS, AND ACTIONS IS SOLELY AT YOUR OWN RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. AURUMFLUX AI, INC. AND ITS PROVIDERS EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, TITLE, MERCHANTABILITY, ACCURACY, AVAILABILITY, RELIABILITY, SECURITY, PRIVACY, COMPATIBILITY, NON-INFRINGEMENT, AND ANY WARRANTY IMPLIED BY COURSE OF DEALING, COURSE OF PERFORMANCE, OR TRADE USAGE.

BONDPERMIT'S OUTPUTS MAY CONTAIN MATERIAL INACCURACIES EVEN IF THEY APPEAR ACCURATE BECAUSE OF THEIR LEVEL OF DETAIL OR SPECIFICITY. YOU ARE RESPONSIBLE FOR EVALUATING AND VERIFYING ALL OUTPUTS BEFORE USE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AURUMFLUX AI, INC.'S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE EXCEED THE TOTAL AMOUNT YOU PAID TO AURUMFLUX IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

IN NO EVENT SHALL AURUMFLUX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, INVESTMENT LOSSES, TRADING LOSSES, BUSINESS INTERRUPTION, COST OF SUBSTITUTE SERVICES, OR FINES AND PENALTIES ARISING FROM YOUR RELIANCE ON AI-GENERATED OUTPUTS, EVEN IF AURUMFLUX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE LAWS OF SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES OR CERTAIN TYPES OF DAMAGES, SO SOME OR ALL OF THE DISCLAIMERS AND LIMITATIONS IN THESE TERMS MAY NOT APPLY TO YOU.

15. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS AURUMFLUX AI, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS FROM AND AGAINST ANY AND ALL LIABILITIES, CLAIMS, DAMAGES, EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES AND COSTS), AND OTHER LOSSES ARISING OUT OF OR RELATED TO: (A) YOUR USE OF, OR ALLEGED USE OF, THE SERVICES, OUTPUTS, OR ACTIONS; (B) BUSINESS DECISIONS YOU MAKE BASED ON BONDPERMIT'S REPORTS OR RESEARCH; (C) ANY PRODUCTS OR SERVICES THAT YOU DEVELOP, OFFER, OR MAKE AVAILABLE USING BONDPERMIT'S OUTPUTS; (D) YOUR VIOLATION OF THESE TERMS OR ANY APPLICABLE LAW; (E) YOUR FEEDBACK; OR (F) ANY ACTUAL OR ALLEGED FRAUD, INTENTIONAL MISCONDUCT, GROSS NEGLIGENCE, OR CRIMINAL ACTS COMMITTED BY YOU.

16. Data and Privacy

Your use of BondPermit is also governed by our Privacy Policy. We do not sell your data. We do not use your data to train AI models. See our Privacy Policy for full details.

17. Sub-processors and Third-Party Services

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in Los Angeles County, California. Judgment on the arbitration award may be entered in any court of competent jurisdiction. Either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.

Class action waiver: You agree that any dispute will be resolved on an individual basis and that you waive any right to participate in a class action, collective action, or representative proceeding.

20. Your Rights (GDPR / CCPA)

We will respond within 10 business days.

22. Modifications

We may update these Terms at any time. Material changes will be communicated to active subscribers via email at least 30 days before taking effect. Continued use after changes constitutes acceptance.

23. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

24. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AurumFlux regarding the Service.

26. Permit Denial Forecast (Historical Patterns)

26.1. BondPermit reports may include a "Common Delay Patterns" section showing historical reasons why applications in your jurisdiction have faced delays. This data is sourced from public records, FOIA requests, agency annual reports, and aggregate complaint data.

26.2. Delay patterns are historical observations, not predictions about your specific application. Your circumstances, documentation, and timing may produce different results than the historical average.

26.3. Pattern data is not legal advice. It does not constitute professional consultation about your specific situation. Always verify current requirements directly with the issuing agency.

26.4. Frequency percentages are based on available public data within the years cited and may not reflect current conditions. We make no warranty that historical patterns will continue.

27. Watchdog Monitoring Service (Optional Subscription)

27.1. Customers may subscribe to the optional Watchdog Monitoring service ($9.99/month USD, recurring) which provides ongoing compliance support including a monthly compliance digest, renewal reminders (30/60/90 days before each permit and license expiration as identified in the customer's BondPermit report), new-grant and new-program alerts for the customer's state and city, and re-research of report sections when the customer's business changes (new location, new service line, expanded staff). Real-time day-of change-detection alerts are roadmapped for Month 2 of the service; until that feature ships, ongoing monitoring is delivered as a monthly compliance digest. Watchdog requires affirmative opt-in via Stripe Checkout and is cancellable at any time.

27.2. AI disclosure (Colorado AI Act § 6-1-1701 and California AB 2013). Watchdog compliance digests are AI-assisted research summaries generated from publicly available federal, state, county, and city .gov sources at the time the digest is composed. They are research deliverables, not legal, tax, financial, or compliance advice. We do not certify, verify, or guarantee the accuracy of any digest, and any specific item should be verified with the issuing authority before action.

27.3. Watchdog provides best-effort monitoring. We do not guarantee that all regulatory changes will be detected, that digests will be delivered on any specific schedule, that renewal reminders will surface every applicable renewal, or that detected information will be reported with complete accuracy. Agencies update fees, forms, and rules without notice; digests reflect only what was publicly available at the time of generation.

27.4. Watchdog content is informational only and not a substitute for direct agency contact, professional legal counsel, or professional tax counsel. Always verify current permit and license requirements with the issuing authority before taking any action based on a Watchdog communication.

27.5. Liability for missed digests, delayed digests, inaccurate digests, missed renewal reminders, or failure of the Watchdog service is limited to a refund of fees paid by the subscriber in the affected billing period, regardless of any damages claimed. This limitation is in addition to and not in derogation of the general liability cap in Section 12.

27.6. Watchdog subscriptions are activated only upon explicit opt-in via Stripe Checkout. We will not enroll any customer in Watchdog without affirmative consent. Customers who purchase only the $49 one-time Complete Launch Report are not enrolled in Watchdog and are not charged any recurring fee.

27.7. Auto-renewal & cancellation. By subscribing to Watchdog at $9.99/month, you authorize AurumFlux AI, Inc. to charge your payment method $9.99 USD every month until you cancel. You may cancel at any time by (a) visiting your Stripe customer portal, or (b) emailing [email protected]. Cancellation takes effect at the end of the current billing period; refunds for the current billing period are prorated to the day of cancellation upon written request. Renewal reminders are sent by email no fewer than 7 days before each recurring charge as required by California Auto-Renewal Law (Business & Professions Code § 17600 et seq.).

27.8. AurumFlux may discontinue, modify, or suspend the Watchdog service at any time with at least 30 days' written notice to active subscribers. If Watchdog is discontinued, active subscribers will receive a prorated refund of any unused portion of the then-current billing period.

28. Refund Policy & Error Challenge Process

28.1. BondPermit reports are digital products delivered instantly upon payment. Once a report is generated and delivered, it is considered rendered in full and is non-refundable, except as provided in Section 28.3.

28.2. By completing checkout, you acknowledge that:

28.5. If the challenge is confirmed, you receive a full refund AND a corrected report at no additional charge.

28.6. If the challenge is not confirmed (cited source does not support the claim, or the disputed value is within an acceptable range of agency-stated variance), the original report stands and no refund is issued.

28.7. Generic or non-specific complaints (e.g., "the report is inaccurate" without identifying the specific field, claimed correction, and source) do not constitute a valid challenge and cannot trigger a refund.

28.8. Chargebacks filed with your card issuer or bank without first using the Section 28.3 Error Challenge Process are considered a breach of these Terms. We will respond to such disputes with the evidence package described in Section 28.9 and may report bad-faith disputes to relevant fraud prevention services.

28.9. Dispute Evidence. For each report delivered, we automatically retain: report ID, delivery timestamp, model used, accuracy verification score, permit count, source URLs cited, IP hash, user agent hash, TOS version accepted, and delivery confirmation. This evidence is provided to payment processors in response to any chargeback or dispute.

28a. Confidence Score Disclosure

28a.1. BondPermit reports may include an algorithmic "confidence score" or quality band (e.g., "Verified · 95%"). This score reflects internal metrics including (a) percentage of permits citing .gov source URLs, (b) completeness of required fields, and (c) consistency across independent verification passes.

28a.2. The confidence score is not a guarantee of legal accuracy, completeness, or current applicability. It is an algorithmic metric reflecting the technical quality of automated research at the moment of generation.

28a.3. Even reports scored "high confidence" may contain errors, omissions, or outdated information. You remain responsible for verifying every permit and license requirement directly with the issuing agency before relying on the report.

28b. EU Data Processing Addendum (DPA)

28b.1. Customers located in the European Union, United Kingdom, or Switzerland may request a signed Data Processing Addendum (DPA) by emailing [email protected]. We respond within 5 business days. The DPA covers our role as data processor under GDPR Article 28.
